Senate Concurrent Resolution No. 12

Requesting the superintendent of schools in cooperation with the
secretary of the department of education and the arts to
prepare a report and recommendations as to the best method
of deciding reassignment rights during reductions in force
by county boards of education; and requesting that said
report and recommendations be submitted to the Legislature
prior to the first day of the 1994 regular legislative
session.
Whereas, Reductions in the number of students enrolled in
many counties has caused a reduction in funding necessitating the
elimination of many professional educator positions; and
Whereas, The elimination of significant numbers of
professional educator positions has spawned great debate and
litigation surrounding the rights of individual professional
educators facing the loss of employment during reductions in
force by county boards of education; and
Whereas, The Legislature has amended the statute defining
those rights several times over the recent years; therefore, beit
Resolved by the Legislature of West Virginia:
That prior to the first day of the 1994 regular session, the
superintendent of schools and secretary of the department of
education and the arts collect information and recommendations
regarding reassignment rights during RIFs from the state board,
county boards, county superintendents and teachers and shall
submit their recommendations to the legislative oversight
commission on education accountability and to the entire
Legislature; and, be it
Further Resolved, That the Clerk of the Senate is hereby
directed to forward a copy of this resolution to the state
superintendent of schools and the secretary of the department of
education and the arts.
